If you and your spouse are both somewhat in agreement about the divorce and are on friendly terms, it might be in your favor to discuss the possibility of going through mediation instead of taking your divorce in front of a judge. Mediation means that you and your spouse will meet with a neutral third-party who has special mediating training. The purpose of the mediation is to talk about and resolve issues that pertain to the divorce. Common issues that must be outlined before a divorce is final often include:

  • It’s typically much faster to go through mediation than to wait for a judge to determine the divorce settlement. When you are dependent on a judge to rule on the terms of your divorce, it can take months, depending on what other cases are listed in front of yours.
  • With a mediator, you and your spouse can outline the terms of your divorce down to the last detail.  This means that you can have more certainty of the outcome when you work with your spouse to outline the terms of your divorce versus letting a judge decide. 
  • Most of the time, mediation is less expensive to go through a mediator to agree on the terms of your divorce than it is to go through the court system.
