Child Custody

In the State of Minnesota, custody is discussed in terms of parenting time and parenting plans, but the basic elements remain the same. Child custody is divided into legal custody (who makes the important decisions that parents must make for their children) and physical custody (who has parenting time and when). Both can be either joint or sole, but it’s important to point out that even if physical custody is joint, it doesn’t mean that you will necessarily split your time with the children exactly equally, and even if physical custody is sole, the other parent is still likely to have a visitation schedule. 

Child Support

Child support is the state’s way of ensuring that both parents help support their children financially. Child support payments are calculated according to a state schedule that helps balance the financial support in relation to how much time each parent has the children in his or her care and each parent’s financial means. 

Alimony

Alimony is called spousal maintenance in Minnesota, and while it doesn’t have a part in every divorce, it can be awarded in those situations in which one spouse faces a financial deficit and the other spouse has the financial means to help offset that deficit.
