Frequently Asked Questions

What should I bring to my initial consultation for a divorce?

To make the most of your consultation, bring any existing court documents, pleadings, or orders related to your case. If you have financial documents, custody schedules, or communication records relevant to your case, those can be helpful as well.

What is the difference between mediation and Early Neutral Evaluation?

Mediation involves a neutral third party who helps facilitate negotiations between you and your spouse to reach agreements. Early Neutral Evaluation is a process where a neutral evaluator reviews your case and provides an assessment of likely court outcomes, helping both parties understand the strengths and weaknesses of their positions. Minnesota courts often require one of these alternative dispute resolution methods before allowing cases to proceed to trial.

How do you handle high-net-worth cases?

We take great care when addressing complex financial situations involving substantial assets, business interests, and intricate property division issues. We work to ensure all assets are properly identified, valued, and divided, helping you protect your financial security while efficiently resolving your case.

How do you address cases involving grandparents' custody rights?

We have experience with third-party and grandparent custody cases, which can often be legally complicated. Our team understands the unique legal standards that apply in these circumstances, and we work compassionately with grandparents and others who may be de facto custodians or interested third parties seeking to protect the children’s best interests.

Will my parenting time schedule be 50/50 by default?

Minnesota courts don’t mandate equal parenting time. The judge looks at 12 best-interest factors, including each parent’s availability and the child’s developmental needs, to determine the appropriate allocation of parenting time in a given case. While a 50/50 split is possible, it is not always what is determined.

How does the firm support clients during emotionally challenging cases?

Beyond legal representation, we seek to provide comprehensive emotional support through our integrated client coaching program. We recognize that family law matters are among life’s most stressful experiences, so we’ve built mindset management into our service model. This includes helping you develop coping strategies, communication skills, and a forward-focused perspective to help you not just survive your case, but thrive beyond it.

What is the typical process for starting a family law case with Atticus Family Law?

Our intake process begins with a meeting with our Client Intake Advisor, who gathers details about your situation, introduces the firm’s holistic approach, and answers initial questions. We then schedule a comprehensive consultation with our dedicated consultation specialist to discuss your case, explore strategies, and ensure you understand the legal process. The consultation fee is credited toward future services, ensuring transparency and value from the start.

How does the firm approach complex family law cases with overlapping issues?

Where other lawyers might pause at the intersection of custody, support, property division, and other issues, our team is already strategizing. Our training and experience position us to handle multi-layered situations efficiently. We take a 360-degree approach to understand how all these issues may intersect and prioritize your goals while addressing all aspects sensibly.

What is the role of the client coach in my case?

Our client coach provides personalized, unlimited support to help you navigate the emotional and practical challenges of your case. With experience in mediation, conflict coaching, and co-parenting, she offers guidance on managing stress, minimizing conflict, and preparing for mediation or settlement negotiations. This service is meant to empower you to focus on achieving successful outcomes and thriving in life beyond legal matters.

What’s your policy on client communication and updates?

Communication is a cornerstone of our service. We want to be transparent with you and build trust, so we strive to communicate clearly and as frequently as your case requires. All communication is conducted in a manner that preserves client confidentiality and privacy.

We recognize that this list is not exhaustive. We invite you to contact our team and schedule a consultation to answer any further questions or concerns you may have.
