Hennepin County Divorce Lawyers

If you are facing a divorce – or are simply at the stage of considering divorce – it’s in your best interest to consult with an experienced Hennepin County divorce lawyer sooner rather than later. The consequences of divorce will significantly affect you and your children’s future, and it’s important to move forward with the confidence that comes from knowing you are working with a dedicated legal professional who is committed to advocating for divorce terms that protect your rights.

The Divorce Basics

Every divorce follows its own path, and every party to the divorce has his or her own unique goals. That said, there are basic components of divorce that apply across the board, including:

  • Your Child Custody Arrangements – For every divorce that involves children, the child custody arrangements are naturally your primary concern. Because you both want what is best for your children, you may be able to agree on arrangements between yourselves – with the guidance of your respective divorce attorneys – that suit your family’s needs. Typically, both of you will share legal custody of your children, and as such, the two of you will make important decisions related to their education, health care, and religious upbringing on their behalf. Further, one parent typically becomes the primary custodial parent with whom the children live primarily, and the other parent has a visitation schedule.
  • The Division of Marital Property – The State of Minnesota is an equitable distribution state, which means that the property you acquire together as a married couple will be divided upon divorce in a manner that is considered fair under the given circumstances – rather than being divided exactly equally. Regardless of who made the purchases or whose name is on the property, if you acquired an asset while you were married, it remains marital property. Exceptions include gifts or inheritances that either of you received in your name alone. Suffice to say that the division of marital property can quickly become a heated topic, and factors such as owning a business, having high assets, or owning complex properties all tend to complicate the issue further.
  • Child Support – Minnesota, like all other states, holds both parents responsible for financially supporting their children throughout their childhoods, and as such, the parent with the visitation schedule generally pays the primary custodial parent child support that is based on state child support calculation guidelines. This support is intended to help balance the cost of supporting children on a daily basis.
  • Spousal Maintenance – Spousal maintenance – or alimony – is not a given, but if one spouse is facing a financial need post-divorce and the other spouse has the financial means to offset that need, alimony is often deemed appropriate. Alimony is usually a temporary fix to help the spouse with financial need find his or her bearing in the aftermath of divorce, but the duration and amount of the alimony are based on a variety of important factors that include the marriage’s duration and each spouse’s contribution to the marriage.
