Hennepin County Family Law Attorneys

If you are facing a divorce or have another type of family law issue, it’s in you and your children’s best interest to work closely with an experienced Hennepin County family law attorney. Obtaining an outcome that works for you into your future in the first place is critical, and if the terms you’re living with aren’t working, it may be time to seek a modification. Whatever your needs, an experienced family law attorney can help.

Family Law Orders

Every divorce and family law case proceeds in accordance with its own unique circumstances, but the basic components you might experience remain the same, including (as applicable):

  • The Division of Marital Property – The property that you and your spouse acquired together as a married couple will be divided in a manner that is deemed equitable or fair rather than necessarily equally.
  • Child Custody Arrangements – Generally, both parents share legal custody, which means they both share in making important decisions on behalf of their children. Further, one parent typically becomes the primary custodial parent with whom the children live primarily while the other parent has a visitation schedule.
  • Child Support – The parent with the visitation schedule usually pays child support that’s based on a state calculation methodology to the primary custodial parent.
  • Spousal Maintenance – Spousal maintenance, or alimony, only comes into play if one divorcing spouse has a financial need in relation to supporting himself or herself post-divorce, and the other has the financial means to meet that need (usually temporarily).

Agreeing to Terms

If you and your divorcing spouse or your child’s other parent can come to terms that you are both willing to sign off on related to divorce or child-related matters, your case will likely move ahead reasonably efficiently. Even if you can agree on terms related to one or more elements, it can help make the family law process proceed more smoothly.

When You Can’t Reach an Agreement

Many parties encounter issues about which they are unable to reach an agreement on their own. In such instances, the following steps can all be taken to resolve the matter in question:

  • Your respective family law attorneys can negotiate on your behalf in an effort to find common ground on the matter.
  • You can attend mediation at which you and your respective family law attorneys will work within the parameters of mediation and with the guidance of a neutral mediator in an attempt to find terms that you both find acceptable.
  • If you are unable to reach an agreement, the court will make the necessary decisions on your behalf.
