  • Spousal Maintenance – Spousal maintenance, or alimony, only comes into play if one divorcing spouse has a financial need in relation to supporting himself or herself post-divorce, and the other has the financial means to meet that need (usually temporarily). 

 

Agreeing to Terms

If you and your divorcing spouse or your child’s other parent can come to terms that you are both willing to sign off on related to divorce or child-related matters, your case will likely move ahead reasonably efficiently. Even if you can agree on terms related to one or more elements, it can help make the family law process proceed more smoothly. 

When You Can’t Reach an Agreement

Many parties encounter issues about which they are unable to reach an agreement on their own. In such instances, the following steps can all be taken to resolve the matter in question:

  • Your respective family law attorneys can negotiate on your behalf in an effort to find common ground on the matter.
  • You can attend mediation at which you and your respective family law attorneys will work within the parameters of mediation and with the guidance of a neutral mediator in an attempt to find terms that you both find acceptable. 
  • If you are unable to reach an agreement, the court will make the necessary decisions on your behalf.
